Indonesia Obliges E-Commerce to Partner with Customs DG in New Regulation

TEMPO.CO, Jakarta - Finance Minister Sri Mulyani Indrawati issued the Finance Minister Regulation No. 96 of 2023 on Customs, Excise, and Tax Provisions for the Import and Export of Consigned Goods. One of the articles provided in the regulation obliged organizers of trade through electronic systems (PPMSE) or e-commerce to partner with the Directorate General of Customs and Excise.

"PPMSE will be treated as importers of consigned goods as a result of trade. meanwhile, in previous regulation No. 119 of 2019, PPMSE acted as a partner or a third party," said the Director of Customs at the ministry Fadjar Donny Tjahjadi at the Finance Ministry Office yesterday, October 12, 2023.

Additionally, Donny said, the recent regulation provided an automatic Customs and Excise process which offers a quicker and more accurate customs clearance through e-catalog and e-invoice. Finance Minister Regulation No. 96 of 2023 also regulates the duty and responsibility of each related stakeholder. 

"To create a legal certainty and clear contribution by each party to establish a better service," Donny said.

Donny hopes the regulation will improve import service without abandoning supervision and accuracy of data. Meanwhile, from an export perspective, Donny hopes this regulation will improve the customs and excise administrative process on exports of consigned goods. 

The regulation itself was issued following President Jokowi's instruction to tighten the regulation on imports to protect MSMEs and reduce the import of consumptive goods.
